Wellington North council have backed a letter by the Association of Municipalities of Ontario addressed to the Ontario Attorney General Doug Downey.
The paper written looks into the issue of municipalities who can be suffered to pay out large payments in lawsuits which involve liability which they may have minimal fault to.
Municipalities in Ontario run under a principal of joint and several liability, meaning a municipality would end up with large payments awarded in liability lawsuits even if they are found to be minimally at fault.
The paper writes it’s unfair for property taxpayers to have to carry the share of a damage award when a municipality is found at minimal fault or to have to take the responsibility of someone else’ mistake.
