Superior Court rules on Harriston Development dispute

An Ontario Superior Court has made it’s decision in regards to a dispute between a pair of Harriston residents and the Town of Minto and it’s Chief Building Official.

The case stems primarily from the distinction of a storey and a building development that was thought by residents and neighbours Rolf and Kerri Schuettel to have skirted a previous OMB agreement restriction on type of properties could be built.

Key to the dismissal of most issues being considered was the timeline in filing the application which fell outside of the Building Code Act 20 day appeal timeframe.

The residents were also found due to pay the Town costs in regards to defending themselves in the case.

Upheld in the case were a restriction on possible uses for a municipal property adjoining the development.

It now can only be a turnaround.
